Terms &
Conditions
1. This
agreement sets
forth the
terms and
conditions
pursuant to
which Security
Travel Bureau,
located at
1207 Market
Street,
Wheeling, WV
26003,
in return for
payment by the
participant of
the amount
specified as
the , agrees
to provide the
subject
charter
flights.
2.
RESPONSIBILITY:
Security
Travel., the
Charter
operator, as
principal is
responsible to
the charter
participants
for arranging
and providing
all of the
services and
accommodations
offered as
constituting
the charter
trip.
Provided,
however, that
in the
absence of
negligence on
its part, the
charter
operator is
not
responsible
for personal
injury or
property
damage arising
out of the act
of
negligence of
any direct air
carrier,
hotel, or
other person
rendering any
of the
services being
offered in
connection
with the
charter.
3. PAYMENT: A
deposit of
$100.00 and a
signed
contract/reservation
form for each
person/party
is required to
reserve a
place on the
charter. Final
payment is due
no later than
45 days prior
to departure.
If the charter
is fully
booked when
your
reservation is
received, your
payment will
be returned.
Payment must
be made within
5 days of
making your
reservation or
space will be
canceled. All
checks and
money
orders must be
made payable
to National
City Bank,
Security
Travel.
Account, or to
your retail
travel agent.
4. TOUR PRICE:
The tour price
as stated on
your brochure
includes a
round-trip
charter flight
from
Pittsburgh to
Orlando, and
back to
Pittsburgh on
US Airways. It
also includes
all applicable
taxes,
including all
airport and
"head"
taxes as well
as complete
package as
described in
the tour
offering. Any
tips or
gratuities not
specifically
mentioned as
included are
at the
discretion of
the charter
participant.
Except for
"Major
Changes"
as described
below, no
refund may be
made for any
accommodations
or services
included in
the charter
price, which
are
voluntarily
not utilized
by the charter
participant.
No reduction
for children
unless as
third occupant
o f same room.
The charter
participant
shall pay any
airline fuel
surcharge.
Children use
existing
bedding. All
prices are
subject to
change without
advance
notice. Rates
and
information
are accurate
at time of
printing.
5. BAGGAGE:
The direct air
carrier limits
its liability
for loss of or
damage to
personal
baggage. Such
liability
shall be
limited to the
actual value
of such
baggage, but
shall not be
more than: for
DOMESTIC
flights, $1250
per person for
both checked
and unchecked
baggage.
A higher value
may be
declared with
respect to the
baggage, in
which case,
additional
payment and
such
declaration
must be made
in advance of
departure in
accordance
with the
direct air
carrier’s
applicable
tariff.
6. AIRCRAFT:
This flight
will be
performed
using a US
Airways (a
U.S. certified
airline) 737,
MD80, A319 or
similar
aircraft.
Royal Travel
Service, Inc.,
and US Airways
reserve the
right to
substitute
equivalent
aircraft if
necessary. We
also reserve
the right to
make
intermediate
stops to pick
up additional
passengers if
necessary.
7. SURETY
BOND: Your
payment is
protected in
part by a
security
agreement
which we have
obtained from
National City
Bank, 200 West
Beau Street,
Washington, PA
15301. Unless
a charter
participant
files a claim
with us, or if
the charter
participant is
unavailable,
with the
securer,
National City
Bank within 60
days after the
completion of
the charter,
the securer
shall be
released from
all liability
under the bond
to that
participant.
8. TERMS: The
Charter
operator
(Security
Travel.) is
acting as
intermediary
and limited
agent for
suppliers
("principals"
identified in
the brochure)
in selling
services. In
accepting
reservations
or bookings
for services
that are not
directly
supplied by
this agent
(such as air
transportation,
hotel
accommodations,
ground
transportation,
meals, tours,
entrance
tickets,
etc.). This
agency,
therefore,
shall not be
responsible
for the
negligence,
inaction or
breach of
contract or
any actions or
omissions on
the part of
such
suppliers,
etc. which
result in any
loss, damage,
delay or
injury to you,
your travel
companions or
group members,
including but
not limited to
injuries,
damages, or
losses caused
to any
traveler in
connection
with acts of
God, terrorist
activities,
social or
labor unrest,
mechanical or
construction
difficulties,
diseases,
local laws,
climatic
conditions,
abnormal
conditions or
developments,
or any other
actions,
omissions or
conditions
outside this
Agency’s
control. By
embarking upon
the trip, you
and your
traveling
companions
voluntarily
assume all
risks involved
with such
travel,
whether
expected or
unexpected.
The traveler
is hereby
warned of such
risks, and is
advised to
obtain the
appropriate
insurance
coverage
against the
same. Your
retention of
all tickets,
reservation or
bookings after
issuance shall
constitute to
the above and
an agreement
on your part
to convey the
contents
hereto to your
travel
companions or
group members.
Agency or
Travel Agent
is defined to
include the
agency, and
all agents,
employees,
servants,
officers and
directors.
9.
CANCELLATION
AND REFUND
POLICY: If you
cancel your
reservation,
YOUR RIGHT TO
RECEIVE A
REFUND IS
LIMITED, as
set forth in
the following
schedule. All
requests for
refund must be
made in
writing to
Royal Travel
Service Inc.,
P.O. Box 489,
Meadow Lands,
PA 15347, FAX

If your notice
is received 45
or more days
before
departure, you
will receive a
full refund,
less a $50.00
administrative
fee per
person. Within
44 days before
departure, no
refund will be
made unless
the tour seat
is
resold. At any
time, if we
are able to
resell your
seat, or if
you are able
to provide a
substitute, a
full refund
less a $50.00
per person
administrative
fee will be
made. Refunds
will be made
within 21 days
of receipt of
cancellation
documentation.
If we make
MAJOR CHANGES
prior to
departure, you
have the right
to cancel and
receive a full
refund. The
following are
major changes:
1.a change in
the departure
or return
date, unless
the change
results from a
flight delay
experience by
the air
carrier. (If,
however, the
delay is
longer than 48
hours, it will
be considered
a major
change);
2.A change in
the origin or
destination
city, unless
the change
affects only
the order in
which the
cities
named in a
tour package
are visited;
3.A substitute
of any hotel
not listed in
this contract,
and;
4.A price
increase of
MORE THAN 10
PERCENT
occurring 10
or more days
before
departure. In
no event can
we increase
your price
less than 10
days before
departure.
If a major
change must be
made in the
program, we
will notify
you within 7
days after
learning of
the change,
but in any
event at least
10 days before
scheduled
departure. If
less than 10
days before
departure, we
become aware
that a major
change must be
made, we will
notify you as
soon as
possible.
Within 7 days
after
receiving
notification
of a major
change, but in
no event later
than
departure, you
may cancel
your
reservation
and you will
receive a full
refund within
21 days after
cancellation.
If we must
cancel the
charter, we
will notify
you in writing
within 7 days
of the
cancellation,
but in no
event later
than 10 days
before
scheduled
departure
date. We have
no right to
cancel the
charter less
than 10 days
before the
trip. If that
occurs, we
will notify
you as soon as
possible but
no later than
the scheduled
departure
date. If the
charter is
canceled, we
will make a
full refund to
you within 21
days after
cancellation.
**Change fee:
a charge of
$10 per person
will be
assessed for
each revision
made after the
initial
confirmation
on all
guaranteed/paid
bookings to
cover
increased
handling
costs.
Tour Documents
will be mailed
approximately
2 weeks prior
to departure
provided that
the
reservation is
paid in full
and we have
received the
signed
contract. |
